In support of the Coast 2 Coast MLS Data Share’s alignment of services and to create efficiencies in the marketplace both the NEFAR Board of Directors and the realMLS Board of Directors voted to adopt the Florida Realtors® forms and to sunset both NEFAR and realMLS forms. An alternative would be to seek legal assistance to write contracts specifically for your brokerage. NEFAR and realMLS will no longer provide or support the NEFAR or realMLS forms after June 30, 2024 with some exceptions-see below.

Sunsetting the NEFAR and realMLS forms is currently in progress as we begin to inform members of this decision. The sunsetting will be finalized on June 30, 2024. After June 30, 2024, unless specified otherwise, all realMLS and NEFAR forms will no longer be offered on their respective sites and no additional support regarding the forms will be provided thereafter by NEFAR or realMLS.

As you know, the National Association of Realtors (NAR) announced important information regarding the practice changes required for NAR members under the settlement agreement. NAR’s implementation deadline for practice changes required under the settlement is August 17.

Yes, effective August 17,2024 all Participants providing brokerage services to a buyer must have a written agreement in place BEFORE touring a listing (services such as but not limited to identifying potential properties, arranging for the buyer to tour a property, performing or facilitating negotiations on behalf of the buyer, presenting offers by the buyer, or other services for the buyer).
These agreements benefit consumers because they clearly and transparently outline the brokerage services that will be provided by a Realtor Participant and how the Participant will be compensated.
The agreement must describe the broker’s compensation and must include:
- A specific and conspicuous disclosure of the amount or rate of compensation the Participant will receive or how this amount will be determined, to the extent that the Participant will receive compensation from any source
- The amount of compensation in a manner that is objectively ascertainable and not open-ended.
- A term that prohibits the Participant from receiving compensation for brokerage services from any source that exceeds the amount or rate agreed to in the agreement with the buyer
- A conspicuous statement that broker fees and commissions are not set by law and are fully negotiable. (This could be on a separate agreement but is required
MLS Participants who simply market their services or just talk to a buyer—like at an open house or by providing an unrepresented buyer access to a house they have listed will not at that time be required to obtain a Buyer’s Broker Agreement.
The Buyer’s Broker Agreements will be monitored and requested by the MLS for compliance reviews.

One of the benefits of moving to the Florida Realtor forms is that members have access to the Florida Realtors Legal Hotline which has a highly respected team of attorneys with expertise on the Florida Realtor forms and they can assist with your questions. You will need to rewrite the offer on the Florida Realtor forms as there will be no NEFAR or realMLS support for the forms after June 30, 2024 so it is advised that you begin using the FR forms as soon as possible. This is why you should also sign up for the webinar, online, and in-person training to be offered now through June 30, 2024.
NEFAR and realMLS have been sunset as of June 30, 2024 and no one is authorized to use the forms after June 30.
